Bahse konu kanunun 2. maddesinde s\u00f6z konusu \u00f6zel g\u00fcnler say\u0131lm\u0131\u015f olup; bunlar; <\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"has-inline-color has-black-color\">A) Resmi Bayram G\u00fcnleri:<\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><span class=\"has-inline-color has-black-color\">23 Nisan g\u00fcn\u00fc Ulusal Egemenlik ve \u00c7ocuk Bayram\u0131d\u0131r.<\/span><\/li><li><span class=\"has-inline-color has-black-color\">19 May\u0131s g\u00fcn\u00fc Atat\u00fcrk&#8217;\u00fc Anma ve Gen\u00e7lik ve Spor Bayram\u0131 g\u00fcn\u00fcd\u00fcr.<\/span><\/li><li><span class=\"has-inline-color has-black-color\">30 A\u011fustos g\u00fcn\u00fc Zafer Bayram\u0131d\u0131r.<\/span><br><\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"has-inline-color has-black-color\">B) Dini Bayram G\u00fcnleri:<\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><span class=\"has-inline-color has-black-color\">Ramazan Bayram\u0131; Arefe g\u00fcn\u00fc saat 13.00&#8217;ten itibaren 3,5 g\u00fcnd\u00fcr.<\/span><\/li><li><span class=\"has-inline-color has-black-color\">Kurban Bayram\u0131; Arefe g\u00fcn\u00fc saat 13.00&#8217;ten itibaren 4,5 g\u00fcnd\u00fcr<\/span><\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"has-inline-color has-black-color\">C) Di\u011fer Ulusal Tatil G\u00fcnleri<\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li><span class=\"has-inline-color has-black-color\">Y\u0131lba\u015f\u0131 G\u00fcn\u00fc<\/span><\/li><li><span class=\"has-inline-color has-black-color\">1 May\u0131s G\u00fcn\u00fc<\/span><\/li><li><span class=\"has-inline-color has-black-color\">15 Temmuz G\u00fcn\u00fc<\/span><\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"has-inline-color has-black-color\">\u0130\u015f S\u00f6zle\u015fmelerinde Ulusal Bayram ve Genel Tatil<\/span><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015f\u0131l\u0131p \u00e7al\u0131\u015f\u0131lmayaca\u011f\u0131 toplu i\u015f s\u00f6zle\u015fmesi veya i\u015f\u00e7i ve i\u015fveren aras\u0131nda imzalanacak i\u015f s\u00f6zle\u015fmeleri ile kararla\u015ft\u0131r\u0131labilir. S\u00f6zle\u015fmelerde bu hususa ili\u015fkin herhangi bir h\u00fck\u00fcm bulunmamas\u0131 halinde ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015f\u0131lmas\u0131 i\u00e7in i\u015f\u00e7inin onay\u0131n\u0131n al\u0131nmas\u0131 gerekmektedir. <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">(\u0130\u015f Kanunu Madde 44) <\/a>Toplu i\u015f s\u00f6zle\u015fmesi veya i\u015f s\u00f6zle\u015fmelerine hafta tatili, ulusal bayram ve genel tatillere ili\u015fkin d\u00fczenlemeler i\u015f kanununda yer alan d\u00fczenlemelerden daha s\u0131k\u0131 olamaz. S\u00f6z konusu d\u00fczenlemeler yaln\u0131zca i\u015f\u00e7i lehine (avantaj\u0131na) olacak \u015fekilde d\u00fczenlenebilir. Bir ba\u015fka deyi\u015fler, kanunda i\u015f\u00e7iye tan\u0131nan haklar i\u015f s\u00f6zle\u015fmesi ile s\u0131n\u0131rland\u0131r\u0131lamaz. <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">(\u0130\u015f Kanunu Madde 45) <\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"has-inline-color has-black-color\">Ulusal Bayram ve Genel Tatil Alaca\u011f\u0131<\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table is-style-regular\"><table class=\"has-fixed-layout\"><thead><tr><th>UBGT G\u00fcn\u00fc Tatil Yap\u0131l\u0131rsa;<\/th><th>UBGT G\u00fcn\u00fc \u00c7al\u0131\u015f\u0131l\u0131rsa;<\/th><\/tr><\/thead><tbody><tr><td>\u0130\u015f\u00e7i ulusal bayram ve genel tatil g\u00fcn\u00fc olarak kabul edilen g\u00fcnlerde \u00e7al\u0131\u015fmaz ise; <strong>o g\u00fcn\u00fcn \u00fccretleri tam olarak hak kazan\u0131r.<\/strong><\/td><td>\u0130\u015f\u00e7i ulusal bayram ve genel tatil g\u00fcn\u00fc olarak kabul edilen g\u00fcnlerde tatil yapmayarak \u00e7al\u0131\u015f\u0131r ise; <strong>o g\u00fcn\u00fcn tam \u00fccretinin yan\u0131 s\u0131ra \u00e7al\u0131\u015f\u0131lan her g\u00fcn i\u00e7in bir g\u00fcnl\u00fck \u00fccreti \u00f6denir.<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"has-black-color has-text-color\">Ayr\u0131ca \u00f6denmeyen UBGT \u00e7al\u0131\u015fma alacaklar\u0131na yasal mevzuatta \u00f6n g\u00f6r\u00fclen en t\u00fcksek faiz uygulanacakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"has-inline-color has-black-color\">Ulusal Bayram ve Genel Tatil Kapsam\u0131nda \u00c7al\u0131\u015fman\u0131n \u0130spat\u0131<\/span><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><span class=\"has-inline-color has-black-color\"><strong>Ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 iddia eden i\u015f\u00e7i, bu iddias\u0131n\u0131 ispatla y\u00fck\u00fcml\u00fcd\u00fcr.<\/strong> \u0130\u015f\u00e7inin imzas\u0131n\u0131 ta\u015f\u0131yan bordro sahteli\u011fi ispat edilinceye kadar kesin delil niteli\u011findedir. Bir ba\u015fka anlat\u0131mla bordronun sahteli\u011fi ileri s\u00fcr\u00fcl\u00fcp kan\u0131tlanmad\u0131k\u00e7a, imzal\u0131 bordroda yer alan bayram ve genel tatil \u00fccreti \u00f6demesinin yap\u0131ld\u0131\u011f\u0131 varsay\u0131l\u0131r. Bordroda ilgili b\u00f6l\u00fcm\u00fcn\u00fcn bo\u015f olmas\u0131 ya da bordronun imza ta\u015f\u0131mamas\u0131 halinde i\u015f\u00e7i, ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 her t\u00fcrl\u00fc delille ispat edebilir.<\/span><\/p><p><span class=\"has-inline-color has-black-color\">Ulusal bayram ve genel tatillerde \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131n\u0131n ispat\u0131 konusunda i\u015fyeri kay\u0131tlar\u0131, \u00f6zellikle i\u015fyerine giri\u015f \u00e7\u0131k\u0131\u015f\u0131 g\u00f6steren belgeler, i\u015fyeri i\u00e7 yaz\u0131\u015fmalar\u0131, yaz\u0131l\u0131 delil niteli\u011findedir. Ancak, s\u00f6z\u00fc edilen \u00e7al\u0131\u015fman\u0131n bu t\u00fcr yaz\u0131l\u0131 belgelerle kan\u0131tlanamamas\u0131 durumunda, taraflar\u0131n dinletmi\u015f olduklar\u0131 tan\u0131k beyanlar\u0131 ile sonuca gidilmesi gerekir. Bununla birlikte, i\u015fyerinde \u00e7al\u0131\u015fma d\u00fczenini bilmeyen ve bilmesi m\u00fcmk\u00fcn olmayan tan\u0131klar\u0131n anlat\u0131mlar\u0131na de\u011fer verilemez.<\/span><\/p><p><span class=\"has-inline-color has-black-color\">Dairemizce, ulusal bayram ve genel tatil \u00e7al\u0131\u015fmalar\u0131n\u0131n uzun bir s\u00fcre i\u00e7in hesaplanmas\u0131 ve miktar\u0131n y\u00fcksek \u00e7\u0131kmas\u0131 halinde, hakkaniyet indirimi yap\u0131lmas\u0131 gerekti\u011fi kabul edilmektedir. Ancak, ulusal bayram ve genel tatil \u00e7al\u0131\u015fmalar\u0131n\u0131n taktiri delil niteli\u011findeki tan\u0131k anlat\u0131mlar\u0131 yerine, yaz\u0131l\u0131 belgelere ve i\u015fveren kay\u0131tlar\u0131na dayanmas\u0131 durumunda b\u00f6yle bir indirime gidilmemektedir.<\/span><\/p><cite><strong><span class=\"has-inline-color has-black-color\">YARGITAY 7.
