Aksi takdirde s\u00f6z konusu demirba\u015flar nezdinde meydana gelecek zararlar\u0131n talep edilmesi s\u00fcrecinde ispat g\u00fc\u00e7l\u00fc\u011f\u00fc ile kar\u015f\u0131la\u015f\u0131labilir.<\/p>\n\n\n\n<h3 class=\"has-black-color has-text-color wp-block-heading\"><strong>5- Aidat Ve Di\u011fer Giderlerin Kim Taraf\u0131ndan Kar\u015f\u0131lanaca\u011f\u0131 Kararla\u015ft\u0131r\u0131lmal\u0131<\/strong><\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Kirac\u0131, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda, s\u00f6zle\u015fmede aksi \u00f6ng\u00f6r\u00fclmemi\u015fse veya aksine yerel \u00e2det yoksa, \u0131s\u0131tma, ayd\u0131nlatma ve su gibi kullanma giderlerine katlanmakla y\u00fck\u00fcml\u00fcd\u00fcr. Giderlere katlanan taraf, bu giderleri ispat edici belgelerin birer \u00f6rne\u011fini, istem \u00fczerine di\u011fer tarafa vermek zorundad\u0131r. (Madde 341)<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Kanun kapsam\u0131nda Zorunlu Deprem Sigortas\u0131, ev sahibi taraf\u0131ndan kar\u015f\u0131lanmal\u0131d\u0131r. Fakat Bunun d\u0131\u015f\u0131nda kalan aidat, elektirik, su gibi bedellerin nas\u0131l ve kim taraf\u0131ndan kar\u015f\u0131lanaca\u011f\u0131n\u0131n belirtilmesi faydal\u0131 olacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"has-black-color has-text-color wp-block-heading\"><strong>6- S\u00f6zle\u015fme Kapsam\u0131nda Kefil Aran\u0131yor \u0130se \u0130lgili \u015eekil \u015eartlar\u0131 Dikkate Al\u0131nmal\u0131<\/strong><\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yasal mevzuat\u0131m\u0131z kapsam\u0131nda kefil s\u00fcrecinin suistimal edilmesinin \u00f6n\u00fcne ge\u00e7ilmesi i\u00e7in bir\u00e7ok \u015fekil \u015fart\u0131 \u00f6n g\u00f6r\u00fclm\u00fc\u015f olup; kefilin kendi el yaz\u0131s\u0131 ile bu beyan\u0131n\u0131n yaz\u0131lmas\u0131 \u015fart ko\u015fulmu\u015ftur. Kira s\u00f6zle\u015fmesi kapsam\u0131nda kefil \u015fart\u0131 aran\u0131yor ise bu kapsamda gerekli \u015fekil \u015fartlar\u0131na uyuldu\u011funun teyit edilmesi faydal\u0131 olacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"has-black-color has-text-color wp-block-heading\"><strong>7- Alt Kiraya \u0130zin Verilip Verilmeyece\u011fi D\u00fczenlenmeli<\/strong><\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">&#8230;Kirac\u0131, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda, <strong>kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a<\/strong>, kiralanan\u0131 ba\u015fkas\u0131na kiralayamayaca\u011f\u0131 gibi, kullan\u0131m hakk\u0131n\u0131 da devredemez. Alt kirac\u0131, kiralanan\u0131 kirac\u0131ya tan\u0131nandan ba\u015fka bi\u00e7imde kulland\u0131\u011f\u0131 takdirde kirac\u0131, kiraya verene kar\u015f\u0131 sorumlu olur. Bu durumda kiraya veren, kirac\u0131s\u0131na kar\u015f\u0131 sahip oldu\u011fu haklar\u0131 alt kirac\u0131ya veya kullan\u0131m hakk\u0131n\u0131 devralana kar\u015f\u0131 da kullanabilir. (<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098-20120704.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Madde 322<\/a>)<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yukar\u0131da yer vermi\u015f oldu\u011fumu madde h\u00fckm\u00fc gere\u011fince e\u011fer kira ili\u015fkisi kapsam\u0131nda bir alt kira \u00f6ng\u00f6r\u00fclmekte ise bu hususun kira s\u00f6zle\u015fmesinde muhakkak belirtilmesi gerekmektedir.<\/p>\n\n\n\n<h3 class=\"has-black-color has-text-color wp-block-heading\"><strong>8- Kirac\u0131 Taraf\u0131ndan Tadilat Ger\u00e7ekle\u015ftirilecek \u0130se Kapsam\u0131 Belirtilmeli<\/strong><\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Kira s\u00f6zle\u015fmesine konu ta\u015f\u0131nmaz kapsam\u0131nda bir tadilat ger\u00e7ekle\u015ftirilecek ise \u00f6zellikle bu tadilat kar\u015f\u0131l\u0131\u011f\u0131nda kira bedeli \u00fczerinden bir indirim s\u00f6z konusu ise bu hususun kira s\u00f6zle\u015fmesinde belirtilmesini tavsiye ederiz.<\/p>\n\n\n\n<h3 class=\"has-black-color has-text-color wp-block-heading\"><strong>9- Kira Art\u0131\u015f Oran\u0131 Belirlenmeli<\/strong><\/h3>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksi on iki ayl\u0131k ortalama oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r. Taraflarca bu konuda bir anla\u015fma yap\u0131lmam\u0131\u015fsa, kira bedeli, bir \u00f6nceki kira y\u0131l\u0131n\u0131n  t\u00fcketici fiyat endeksi on iki ayl\u0131k ortalama oran\u0131n\u0131  ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenir.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\"><strong>T\u00fcrk Bor\u00e7lar Kanunu Madde 344 &#8211; <\/strong>Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, <strong>bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara <\/strong>g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir.
