Ay\u0131raca\u011f\u0131n\u0131z zaman i\u00e7in te\u015fekk\u00fcr ederim, faydal\u0131 olmas\u0131 dileklerimle.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is mobbing?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Genellikle psikolojik taciz, y\u0131ld\u0131rma olarak T\u00fcrk\u00e7e&#8217;ye \u00e7evrilen Mobbing esas\u0131nda hayat\u0131m\u0131z\u0131n her alan\u0131nda kar\u015f\u0131la\u015fabilece\u011fimiz bir olgudur. \u00d6zellikle \u00e7al\u0131\u015fanlar\u0131n fiziksel ve psikolojik sa\u011fl\u0131klar\u0131n\u0131 tehdit eden ve gerek i\u015f gerekse sosyal hayat\u0131nda olumsuz sonu\u00e7lar do\u011furan bir unsurdur. Bu itibari ile asl\u0131nda tam anlam\u0131yla \u0130\u015f Hukuku&#8217;nda bir d\u00fczenleme \u015feklinde Mobbing olgusuna yer verilmese de, daha sonra detayl\u0131 olarak a\u00e7\u0131klanacak olan manevi tazminat ba\u015fta olmak \u00fczere baz\u0131 hukuki koruma y\u00f6ntemleri ile bireylerin uzak tutulmas\u0131 hedeflenen bir olgu oldu\u011funu s\u00f6ylemek m\u00fcmk\u00fcnd\u00fcr. Zira Mobbing olgusunun ya\u015fatt\u0131\u011f\u0131 psikolojik taciz, gerek kamu gerekse \u00f6zel sekt\u00f6rdeki \u00e7al\u0131\u015fanlar\u0131 istifa etmeye ve intihara kadar s\u00fcr\u00fckleyen zorbaca davran\u0131\u015flar b\u00fct\u00fcn\u00fcd\u00fcr. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Daha basit anlat\u0131m\u0131yla, Mobbing bir veya birka\u00e7 ki\u015finin bir di\u011fer ki\u015fiye ahlaka, eti\u011fe ayk\u0131r\u0131 y\u00f6ntemlerle sistematik \u015fekilde uygulad\u0131\u011f\u0131 psikolojik bir bask\u0131d\u0131r diyebiliriz. Mobbing olgusundan bahsedebilmek i\u00e7in uygulanan bu bask\u0131 ve psikolojik \u015fiddetin devaml\u0131l\u0131\u011f\u0131 gerekmektedir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Mobbing ile anlat\u0131lmak istenen i\u015fyerindeki duygusal taciz, psikolojik \u015fiddet, d\u0131\u015flama, a\u015fa\u011f\u0131lama, rahats\u0131z etme, \u00e7al\u0131\u015fma motivasyonunu, \u00f6zg\u00fcvenini k\u0131rma ve mutsuz etmeye y\u00f6nelik eylemlerdir. Mobbing\u2019in ortaya \u00e7\u0131kmas\u0131na kaynakl\u0131k eden pek \u00e7ok fakt\u00f6r vard\u0131r. Bu fakt\u00f6rler ve m\u00fccadele y\u00f6ntemleri daha sonra detayl\u0131 olarak izah edilecektir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Yap\u0131lan ara\u015ft\u0131rmalar Mobbing&#8217;in nedenlerinin bireysel ya da \u00f6rg\u00fctsel davran\u0131\u015flar \u015feklinde ortaya \u00e7\u0131kt\u0131\u011f\u0131 sonucunu vermektedir. \u00d6zellikle g\u00fcn\u00fcm\u00fczde artan i\u015fsizlik oranlar\u0131, ekonomik krizler nedeniyle firmalar\u0131n k\u00fc\u00e7\u00fclme e\u011filimleri ve yeni kariyer teorilerinin olu\u015fturdu\u011fu firma i\u00e7i rekabet ortamlar\u0131, Mobbing davran\u0131\u015flar\u0131n\u0131 \u00f6nemli oranda artt\u0131rm\u0131\u015ft\u0131r. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bug\u00fcn k\u00fc\u00e7\u00fck veya b\u00fcy\u00fck pek \u00e7ok i\u015fyerinde bireylerin kendisi g\u00f6sterme, \u00f6n plana \u00e7\u0131karma veya kendi eksikliklerini ba\u015fkalar\u0131n\u0131n kusurlar\u0131 ile kapatma gibi e\u011filimlerinin oldu\u011funu g\u00f6rmekteyiz. \u00d6zellikle \u00e7al\u0131\u015fanlar olarak gerek \u00e7al\u0131\u015ft\u0131\u011f\u0131m\u0131z i\u015fyerlerinde, gerekse i\u015f yeri ad\u0131na yapt\u0131\u011f\u0131m\u0131z t\u00fcm i\u015flemlerde bu bask\u0131ya maruz kalmaktay\u0131z. Zira \u00f6yle d\u00fc\u015f\u00fcn\u00fcyorum ki bu bask\u0131n\u0131n ana sebebi bask\u0131y\u0131 kuranlar\u0131n sistem i\u00e7inde kendi sahip oldu\u011fu yeterliliklere sahip ba\u015fka bireylerin yeti\u015fmesi d\u00fc\u015f\u00fcncesini kabullenmek istememesidir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Daha yal\u0131n bir anlat\u0131mla; bir i\u015f yerinde belli alanda uzman olmu\u015f A ki\u015fisi ve mesle\u011finde yeni olan bir B ki\u015fisini ele alal\u0131m. B ki\u015fisi kendini geli\u015ftirerek mesleki anlamda A ki\u015finin \u00f6n\u00fcne ge\u00e7ip parmakla g\u00f6sterilen bir \u00e7al\u0131\u015fan haline gelmi\u015fse ; Mobbing olgusunda bu durum A ki\u015fisini rahats\u0131z etmektedir. B ki\u015fisi, A ki\u015fisinin i\u015f\u00e7isi\/stajyeri olarak \u00e7al\u0131\u015fmakta ise bu psikolojik bask\u0131ya maruz kalabilecektir. Zira A ki\u015fisinin kendisinde g\u00f6rd\u00fc\u011f\u00fc yetersizlik sebebi ile Mobbing uygulamas\u0131 muhtemeldir. \u0130\u015fte vermi\u015f oldu\u011fumuz \u00f6rnekten de anla\u015f\u0131laca\u011f\u0131 gibi, Mobbing sadece i\u015f\u00e7i- i\u015fveren aras\u0131nda olacak diye bir kaide yoktur. Zira Mobbing pek \u00e7ok sosyal ortamda veya i\u015fyerinde bireyler aras\u0131nda da g\u00f6r\u00fclmektedir. Mobbing olgusunda sosyal ortamdan kas\u0131t bireyler aras\u0131 rekabetten ziyade, i\u015f sebebi ile bireylerin bir araya geldi\u011fi ortamlard\u0131r. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Bu sosyal ortamlar i\u015f yemekleri, i\u015f yeri d\u0131\u015f\u0131nda kalan fakat yine i\u015f i\u00e7in bir araya gelinen ortamlard\u0131r. Daha sonra detayl\u0131 olarak izah edilece\u011fi \u00fczere Mobbing olgusunda \u2018\u2019i\u015f\u2019\u2019 kavram\u0131 esas olup, s\u00fcrekli y\u0131ld\u0131rma \u015feklinde kendisini g\u00f6steren bu olgu esas\u0131nda mesleki rekabet kavram\u0131n\u0131n alt\u0131nda yatan psikolojik y\u0131ld\u0131rma anlam\u0131na gelmektedir. Mobbing&#8217;in ana sebebi ; ki\u015finin(i\u015f\u00e7inin) bireysel eksiklikleri de\u011fil; Mobbing uygulayan ki\u015finin \u00e7\u0131karlar\u0131na bu \u015fekildeki davran\u0131\u015flar\u0131n uygun d\u00fc\u015fmesidir. \u00d6zellikle \u00f6zel sekt\u00f6rde olmak \u00fczere pek \u00e7ok i\u015fyerinde, gerek i\u015fveren taraf\u0131ndan gerekse di\u011fer i\u015f\u00e7iler taraf\u0131ndan bir grup i\u015f\u00e7iye Mobbing uygulanmaktad\u0131r. Psikolojik taciz olaylar\u0131n\u0131n baz\u0131lar\u0131 ise, bir i\u015fyeri\/i\u015fveren politikas\u0131 olarak kar\u015f\u0131m\u0131za \u00e7\u0131kabilmektedir. \u0130\u015f s\u00f6zle\u015fmesinin i\u015fveren taraf\u0131ndan feshi halinde ortaya \u00e7\u0131kacak maliyetlerden kurtulmak isteyen baz\u0131 i\u015fverenler, \u00e7al\u0131\u015fan\u0131 psikolojik y\u00f6nden y\u0131pratarak kendi iste\u011fi ile i\u015ften ayr\u0131lmas\u0131n\u0131 sa\u011flama yolunu tercih edebilmektedir. Bunun alt\u0131nda yatan sebep ise \u00f6zellikle i\u015fverenin k\u0131dem tazminat\u0131 \u00f6demeden ka\u00e7\u0131nmas\u0131 olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. En temel \u00f6rne\u011fi ile i\u015fte bu y\u0131ld\u0131rma politikas\u0131 Mobbing te\u015fkil etmekte olup; \u00f6zellikle ba\u011f\u0131ml\u0131 \u00e7al\u0131\u015fan i\u015f\u00e7iler aras\u0131nda s\u0131k\u00e7a kendini g\u00f6stermektedir. Mobbing giderek yayg\u0131nla\u015fmakta olan bir olgu olup bu olgu hakk\u0131nda bireyleri bilgilendirme, denetleme ve sorunlar i\u00e7in \u00e7\u00f6z\u00fcm yollar\u0131 olu\u015fturulmas\u0131 ihtiyac\u0131 duyulmaya ba\u015flanm\u0131\u015ft\u0131r. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Mobbing Nas\u0131l Ortaya \u00c7\u0131kar?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Mesleki yeterlili\u011fin sorgulanmas\u0131, ki\u015fiye g\u00fcvenilmedi\u011finin hissettirilmesi veya \u00f6zg\u00fcvenini kaybettirmeye \u00e7al\u0131\u015f\u0131lmas\u0131, kasten k\u0131sa s\u00fcre i\u00e7inde bitirilemeyecek g\u00f6revler verilmesi, ki\u015fiden bilmesi gereken mesleki bilgilerin saklanmas\u0131, ki\u015finin g\u00f6rmezden gelinmesi, belli bir gruptan soyutlanmas\u0131, yetkilerinin azalt\u0131lmas\u0131 gibi durumlar olabilir. \u00d6rne\u011fin grup \u00e7al\u0131\u015fmalar\u0131 yaparak veya s\u0131k s\u0131k toplant\u0131lar d\u00fczenleyerek \u00e7al\u0131\u015fan bir i\u015fyerini ele alal\u0131m. Bu i\u015fyerinde Mobbing g\u00f6ren X ki\u015fisi \u00e7al\u0131\u015fma arkada\u015f\u0131 olan ve mevkii olarak kendisinden \u00fcst kademede g\u00f6rev yapan A ki\u015fisinden Mobbing g\u00f6r\u00fcyor olsun. Toplant\u0131 g\u00fcn\u00fc A ki\u015fisi, X ki\u015fisinden mesleki olarak bilgi sahibi olmas\u0131 gereken bir konuyu gizlemi\u015f oldu\u011funu varsayal\u0131m. Bu durumda toplant\u0131 esnas\u0131nda X ki\u015fisi , toplant\u0131da tart\u0131\u015f\u0131lan veya kendisine konu ile ilgili y\u00f6neltilen sorulardan haberdar olmayacak, di\u011fer \u00e7al\u0131\u015fma arkada\u015flar\u0131n\u0131n \u00f6n\u00fcnde k\u00fc\u00e7\u00fck duruma d\u00fc\u015fecektir. Bu tip problemler her ne kadar g\u00fcnl\u00fck i\u015fyerinde ya\u015fanan ufak s\u0131k\u0131nt\u0131lar olarak d\u00fc\u015f\u00fcn\u00fclse de, bu durum i\u015fyerinde mutsuz olan bir bireyin aile hayat\u0131na da yans\u0131yacakt\u0131r. Bu sebeple ilk olarak X ki\u015fisinin fark\u0131ndal\u0131\u011f\u0131 Mobbing ile m\u00fccadelede ihtiya\u00e7 duyulan ilk \u015feydir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00d6zetle ; Mobbing her ne kadar g\u00fcnl\u00fck hayat\u0131n bir par\u00e7as\u0131 olsa da ; \u00f6ncelikle bireyin fark\u0131ndal\u0131\u011f\u0131 gerekmekte olup kan\u0131ksanmamal\u0131d\u0131r. Mobbing olgusu hayat\u0131n her alan\u0131nda, her meslek dal\u0131nda kar\u015f\u0131m\u0131za \u00e7\u0131kabilecek psikolojik bir bask\u0131 \u00f6rne\u011fidir. Her \u015feyden \u00f6nce bu olgu, bireyin toplum i\u00e7erisinde de\u011fersiz hissetmesine, kendi \u00f6z varl\u0131\u011f\u0131n\u0131 ve mesleki yeterlili\u011fini sorgulamas\u0131na sebebiyet vermektedir. \u0130\u015f yerinde mutsuz olan ve kendine g\u00fcvenini yitiren bir bireyin , aile ili\u015fkilerinin de iyi olmas\u0131n\u0131n beklenmesi ise farazi olacakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mobbing \u0130le M\u00fccadele Nas\u0131l Olur?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Hayat\u0131n her alan\u0131nda m\u00fccadele i\u00e7in bilgi sahibi olmak gerekmektedir. Bir ba\u015fka anlat\u0131mla bir insan\u0131n bir durumla m\u00fccadele etmesi i\u00e7in o durumun fark\u0131na varmas\u0131, haklar\u0131n\u0131 bilmesi ve sonu\u00e7lar\u0131n\u0131 \u00f6ng\u00f6rmesi gerekmektedir. Mobbing olgusunda da birey \u00f6ncelikle u\u011fram\u0131\u015f oldu\u011fu psikolojik bask\u0131n\u0131n Mobbing\u2019i yani bir psikolojik tacizi olu\u015fturdu\u011funu bilmeli, bunu kan\u0131ksayarak i\u015f hayat\u0131n\u0131n bir par\u00e7as\u0131 olarak g\u00f6rmemeli ve bu durumun ki\u015finin Anayasal haklar\u0131n\u0131 ihlal etti\u011fini, ya\u015fam kalitesini ve \u00e7al\u0131\u015fma motivasyonunu d\u00fc\u015f\u00fcrd\u00fc\u011f\u00fcn\u00fc bilmelidir. \u00d6zetle \u00f6ncelikle bireyin fark\u0131ndal\u0131\u011f\u0131 gerekmektedir. Toplumun ve bireylerin bu konuda bilin\u00e7lenmesi i\u00e7in ise yap\u0131labilecek \u015feyler seminerler d\u00fczenlemek, bro\u015f\u00fcrler da\u011f\u0131tmak olabilece\u011fi gibi, en \u00f6nemlisi ilk olarak kanuni d\u00fczenlemeler yolu ile bu durumun \u00f6n\u00fcne ge\u00e7ilmelidir. Bunun d\u0131\u015f\u0131nda Mobbing ile M\u00fccadele Derne\u011fi bu konudaki en \u00f6nemli sivil toplum kurulu\u015flar\u0131n\u0131n ba\u015f\u0131nda gelmektedir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Mobbing ma\u011fduru; somut delil olmas\u0131 ve resmi kay\u0131tlara girmesi a\u00e7\u0131s\u0131ndan ALO 170 \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik \u0130leti\u015fim hatt\u0131n\u0131 arayarak \u00f6ncelikle \u015fikayetini dile getirmelidir. Mobbing&#8217;in ispatlanmas\u0131 a\u00e7\u0131s\u0131ndan ise e\u011fer ki\u015fide mevcut ise strese ba\u011fl\u0131 fiziksel rahats\u0131zl\u0131klar olarak tan\u0131mlad\u0131\u011f\u0131m\u0131z psikosomatik hastal\u0131klar konusunda mutlaka rapor almal\u0131d\u0131r. Bunun d\u0131\u015f\u0131nda ise; B\u0130MER, C\u0130MER, Etik Kurulu, \u0130nsan Haklar\u0131 ve E\u015fitlik Kurumu ve Kamu Denetleme Kurumu\u2019na da ilgili prosed\u00fcrleri atlamadan ba\u015fvuruda bulunarak \u015fikayetini dile getirmelidir. \u0130laveten Mobbing ma\u011fdurlar\u0131, bir avukat yard\u0131m\u0131 ile i\u015fverene y\u00f6neltecekleri dava ile tazminatlar\u0131n\u0131 alma hakk\u0131na sahiptirler. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mobbing&#8217;in Etkileri Nelerdir?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Mobbing, insan\u0131n mesleki b\u00fct\u00fcnl\u00fck ve benlik duygusunu zedeler . Mobbing&#8217;e maruz kalan ki\u015fi kendine g\u00fcven duygusunu yitirir, kendisini toplumdan soyutlama y\u00f6n\u00fcnde e\u011filim g\u00f6sterir. Huzursuzluk, korku, utan\u00e7, \u00f6fke ve endi\u015fe duygular\u0131n\u0131n yo\u011fun olarak ya\u015fanmas\u0131 \u015feklinde Mobbing olgusu kar\u015f\u0131m\u0131za \u00e7\u0131kacakt\u0131r. Mobbing derecelerine ve etkilerine g\u00f6re s\u0131n\u0131fland\u0131r\u0131lmaktad\u0131r. Bu s\u0131n\u0131fland\u0131rmalara a\u015fa\u011f\u0131da detayl\u0131 olarak yer verilmi\u015ftir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Mobbing\u2019in yaratabilece\u011fi baz\u0131 etkileri \u015fu \u015fekilde k\u0131saca s\u0131ralamak m\u00fcmk\u00fcnd\u00fcr : A\u011flama, uykusuzluk, depresyon, tansiyon, panik atak, kalp krizine kadar giden sa\u011fl\u0131k sorunlar\u0131 ve travma sonras\u0131 stres bozuklu\u011fu yaratabilir, ki\u015finin ailevi ili\u015fkileri ba\u015fta olmak \u00fczere bireysel ili\u015fkileri zarar g\u00f6rebilir. G\u00f6r\u00fclece\u011fi \u00fczere Mobbing \u00f6ncelikle ki\u015finin ruhsal ve fiziksel b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc zedeler. Daha \u00f6nce yap\u0131lm\u0131\u015f ve s\u0131n\u0131fland\u0131r\u0131lm\u0131\u015f ara\u015ft\u0131rmalara g\u00f6re, her ne kadar Mobbing\u2019in etkileri bireysel ve \u00f6rg\u00fctsel olarak s\u0131n\u0131fland\u0131r\u0131lm\u0131\u015f olsa da; Mobbing neticesinde bu etkiler d\u0131\u015f\u0131nda toplumsal olarak baz\u0131 etkiler ortaya \u00e7\u0131kacakt\u0131r. Zira duygusal \u015fiddet ma\u011fduru olan bir bireyin sa\u011fl\u0131k giderleri, bireylere ve \u00f6rg\u00fctlere y\u00fcklemi\u015f oldu\u011fu ekonomik y\u00fck\u00fcn yan\u0131 s\u0131ra devlete de ekonomik bir y\u00fck getirmektedir. Bununla birlikte, duygusal \u015fiddet sonucu mesleki yeterlili\u011fini yitirmi\u015f, duygusal y\u00f6nden t\u00fckenmi\u015f, sa\u011fl\u0131ks\u0131z bireylerin toplum i\u00e7erisinde faydal\u0131 olmas\u0131n\u0131 beklemek i\u015ften bile de\u011fildir. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mobbing&#8217;e Maruz Kalan Ki\u015filerin Hukuki Haklar\u0131 Nelerdir?<\/h2>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">\u00c7al\u0131\u015fanlar\u0131n Mobbing ile bireysel olarak m\u00fccadele edebilmeleri i\u00e7in \u00f6ncelikle haklar\u0131n\u0131 \u00e7ok iyi bilmeleri ve haklar\u0131n\u0131 aramaktan \u00e7ekinmemeleri gerekmektedir. Ki\u015finin \u00f6ncelikle mesleki niteliklerini geli\u015ftirerek kendine \u00f6zg\u00fcven yaratmas\u0131 gerekmektedir. Bu anlamda ki\u015finin kendisini \u2018kurban\u2019 zihniyetinden kurtarmas\u0131, kontroll\u00fc ad\u0131mlar atarak, \u00f6n\u00fcndeki t\u00fcm se\u00e7enekleri de\u011ferlendirmesi gerekmektedir( Kap\u0131k\u0131ran ve Fiyakal\u0131, 2006: 16).Her \u015feyden \u00f6nce bir \u015feye kar\u015f\u0131 korunabilmek i\u00e7in onu tan\u0131mak ve bilmek gerekir. Bu nedenle \u00f6ncelikle konuya ili\u015fkin Bakanl\u0131k ve ilgili kurumlarca yap\u0131lan bilin\u00e7lendirmeye y\u00f6nelik faaliyetler artt\u0131r\u0131lmal\u0131, konuya dikkat \u00e7ekilmelidir. Mobbing&#8217;e maruz kalan \u00e7al\u0131\u015fanlar\u0131n \u0130\u015f s\u00f6zle\u015fmesinin hakl\u0131 nedene dayanarak feshedebilme hakk\u0131 vard\u0131r. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Belli \u015fartlarda ise Mobbing uygulayan i\u015fverenden ayr\u0131mc\u0131l\u0131k tazminat\u0131 isteyebilme hakk\u0131 do\u011facakt\u0131r. Bor\u00e7lar Kanunu ve T\u00fcrk Medeni Kanunu\u2019na g\u00f6re ise Mobbing ma\u011fdurunun manevi tazminat hakk\u0131 do\u011facakt\u0131r. Mobbing\u2019e u\u011frayan i\u015f\u00e7i, Mobbing uygulayan i\u015fvereni veya bir ba\u015fka i\u015f\u00e7iyi dava edebilir ve manevi tazminat talebinde bulunabilir. Ko\u015fullar\u0131 s\u00f6z konusu ise i\u015f\u00e7i, k\u00f6t\u00fc niyet tazminat\u0131 h\u00fck\u00fcmlerine de ba\u015fvurabilir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Mobbing&#8217;in i\u015f\u00e7inin ki\u015filik haklar\u0131na bir sald\u0131r\u0131 oldu\u011fu ve bu ba\u011flamda i\u015f\u00e7inin korunmas\u0131 gerekti\u011finde ku\u015fku yoktur. Bu durumda Mobbing&#8217;e maruz kalan i\u015f\u00e7inin T\u00fcrk Medeni Kanunu&#8217;nun 25\u2019e 1. maddesindeki \u201ckoruma davalar\u0131\u201d olarak adland\u0131r\u0131lan sald\u0131r\u0131ya son verilmesi davas\u0131, sald\u0131r\u0131n\u0131n \u00f6nlenmesi davas\u0131 ve sald\u0131r\u0131n\u0131n tespiti davas\u0131 yollar\u0131na ba\u015fvurabilirler. Mer-i <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">4857 <\/a>say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda cinsel taciz eylemi hem i\u015f\u00e7iye (4857\/24) hem i\u015fverene (<a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">4857<\/a>\/25) hakl\u0131 nedenle derhal fesih hakk\u0131 vermektedir. Buna g\u00f6re i\u015fverenin i\u015f\u00e7iye cinsel tacizde bulunmas\u0131 ya da i\u015f\u00e7inin di\u011fer bir i\u015f\u00e7i ya da i\u015fyerine gelen \u00fc\u00e7\u00fcnc\u00fc ki\u015filer taraf\u0131ndan cinsel tacize u\u011framas\u0131 ve bu durumu i\u015fverene bildirmesine ra\u011fmen gerekli \u00f6nlemlerin al\u0131nmamas\u0131 hallerinde i\u015f\u00e7i s\u00fcresi belirli olsun veya olmas\u0131n i\u015f s\u00f6zle\u015fmesini s\u00fcrenin bitiminden \u00f6nce veya bildirim s\u00fcresini beklemeksizin 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 24. maddesinin II. bendinin b ve d f\u0131kralar\u0131 uyar\u0131nca hakl\u0131 nedenle derhal feshedebilecektir. Keza, ayn\u0131 Kanunun 25. maddesinin II. bendinin c f\u0131kras\u0131 uyar\u0131nca \u201c<em> \u0130\u015f\u00e7inin i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131 \u201d halinde i\u015fveren cinsel tacizde bulunan i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle tazminats\u0131z olarak feshedebilir. \u0130\u015f\u00e7inin, i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131 hakl\u0131 neden i\u00e7in yeterli olup, tacize u\u011frayan i\u015f\u00e7inin, tacizci i\u015f\u00e7i ile ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015fmas\u0131 \u015fart de\u011fildir. <\/em>( MOLLAMAHMUTO\u011eLU, Hamdi, \u0130\u015f Hukuku, s.486.) Kanunlar\u0131m\u0131zda maalesef hen\u00fcz Mobbing\u2019i t\u00fcm unsurlar\u0131 ile d\u00fczenleyen herhangi bir h\u00fck\u00fcm bulunmamaktad\u0131r.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Ancak, baz\u0131 unsurlar\u0131 ile ilgili olarak do\u011frudan veya dolayl\u0131 yasal d\u00fczenlemeler s\u00f6z konusudur. Anayasam\u0131zda, 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nda, 2821 say\u0131l\u0131 Sendikalar Kanunu\u2019nda ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nda Mobbing\u2019e giren eylem ve davran\u0131\u015flarda bulunma durumunda hak ve y\u00fck\u00fcml\u00fcl\u00fck d\u00fczenlemelerinin mevcut oldu\u011fu bilinmelidir. <\/p>\n\n\n\n<p class=\"has-text-align-justify has-black-color has-text-color\">Mobbing\u2019e maruz kalma kadar onun ispatlanmas\u0131 da b\u00fcy\u00fck \u00f6neme haizdir. Hukukun her alan\u0131nda oldu\u011fu gibi, Mobbing olarak adland\u0131r\u0131lan eylem ve davran\u0131\u015flara maruz kalan i\u015f\u00e7i ya da i\u015f\u00e7iler yasal anlamda hakl\u0131 konuma gelmek istiyorlarsa ma\u011fduriyetlerini dile getirmelerinin yan\u0131 s\u0131ra m\u00fcmk\u00fcnse somut belgelerle, bu m\u00fcmk\u00fcn de\u011filse tan\u0131k beyanlar\u0131yla bu durumu ispat etmelidirler.
