MATERNITY LEAVE

  1. Labor Law |‘According to Article 74 of the law; “It is essential that female workers are not employed for a total of sixteen weeks, eight weeks before and eight weeks after childbirth. With the doctor's approval, if the working woman wishes, she can work until three weeks before childbirth and use the remaining leave after childbirth. (In case of multiple pregnancies, it is calculated as +2 weeks.)
  2. If the mother gives birth prematurely, any leave she was unable to use before the birth will be added to her post-birth leave.
  3. If the mother dies during childbirth or her maternity leave, any unused post-natal leave days are granted to the father.
  4. In addition, one of the spouses or the adoptive parent who adopts a child under the age of 3 is granted 8 weeks of maternity leave from the date of the child's actual handover.

POSTNATAL LEAVE

There is a right to 6 months of unpaid leave. The employer is obligated to grant this leave. After the unpaid leave, the right to part-time work comes into effect. Part-time work can be requested for 60 days after the first birth, 120 days after the second birth, and 180 days after subsequent births. In these cases, the employer will pay the employee half the salary while they work part-time.

MATERNITY LEAVE

Maternity leave is governed by Law No. 4587. Labor Law | Based on this, female employees are granted a total of one and a half hours of breastfeeding leave per day to breastfeed their children under one year old. The female employee herself determines the hours between which this leave will be used or how it will be divided. This time is counted as part of the mother's daily working hours.

Law No. 654 Civil Servants Law‘According to the law, female civil servants are granted three hours of breastfeeding leave per day for the first six months after the end of their post-natal maternity leave, and one and a half hours per day for the second six months.

Finally, combining leave hours to avoid coming to work is not allowed. The purpose of this legally recognized right is to ensure the baby is fed daily. However, alternatives can, of course, be determined by the employer and employee.
